Terms of service
1. Agreement
These terms are an agreement between you and FAMVII LLC (“we”, “us”), 572 Big Stone Dr, Sunbury, OH 43074, for your use of BudgetKind: the Android app, the web app and budgetkind.com (the “Service”). By using the Service you agree to these terms and to our privacy policy. If you don’t agree, don’t use the Service.
2. Eligibility
You must be at least 18 years old and a resident of the United States to use the Service.
3. What BudgetKind is, and isn’t
BudgetKind is a personal budgeting tool. It is not a bank, doesn’t hold or move money, and doesn’t provide financial, investment, tax or legal advice, loans or credit. Information in the app (including categories, detected bills, “leaks”, budgets, goals, projections and answers to questions about your spending) is for your general information, may be incomplete or inaccurate, and depends on data from you, your files and your financial institutions. Check important details with your financial institution before relying on them.
4. Early access
BudgetKind is in early testing. Bank linking currently uses Plaid’s test environment only, so real bank accounts can’t be connected yet. Features may change, be limited or be withdrawn, and the Service may sometimes be unavailable.
5. Your account and security
Most of BudgetKind works without an account. If you create a cloud account, keep access to your email secure (sign-in codes are sent there) and tell us promptly about any unauthorized use. You are responsible for activity on your account and your device, including choosing whether to use App lock.
6. Price
BudgetKind is currently free. We plan to offer an optional paid plan later. Before you can buy anything, we’ll show the price, any trial and how renewal and cancellation work, and we’ll update these terms. Purchases through Google Play will also be subject to Google Play’s terms and refund policies.
7. Bank connections through Plaid
When you connect a financial account, you do so through Plaid Inc. By connecting, you authorize us and Plaid to access your account information on your behalf as described in the privacy policy, and you agree to the Plaid End User Privacy Policy. Access is read-only. We don’t control your financial institutions or Plaid and aren’t responsible for their availability, accuracy or delays. Institutions may ask you to reconnect from time to time.
8. Your data
Your financial data belongs to you. You give us permission to store, process and display it only as needed to provide the Service to you, as described in the privacy policy. Data that stays on your device is your responsibility to back up; the app can export it. You can delete your data and account at any time (see Delete your account).
9. Acceptable use
Don’t misuse the Service: no unlawful use, accessing other people’s accounts or data without permission, interfering with or probing the Service’s security, reverse engineering except as the law allows, automated scraping, or reselling the Service.
10. Demo mode
Demo mode uses sample data that doesn’t describe real people or accounts.
11. Our intellectual property
The Service, including its software, design, text and the BudgetKind name and logo, is owned by FAMVII LLC or its licensors. We grant you a personal, non-exclusive, non-transferable license to use the Service under these terms. Fonts are used under the SIL Open Font License.
12. Feedback
If you send us ideas or feedback, we may use them without obligation to you.
13. Suspension and termination
You can stop using the Service at any time and delete your data as described in the privacy policy. We may suspend or end access if you breach these terms or if needed to protect the Service or other users. Sections that by their nature should survive (for example 3, 8 and 14–17) survive termination.
14. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.
15. Limitation of liability
TO THE EXTENT PERMITTED BY LAW, FAMVII LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR FUNDS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$50.
16. Indemnity
You agree to indemnify FAMVII LLC against claims arising from your misuse of the Service or breach of these terms, to the extent permitted by law.
17. Governing law and disputes
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware County, Ohio, unless the law requires otherwise.
18. App stores
These terms are between you and FAMVII LLC, not Google. Google is not responsible for the Service or its content.
19. Changes
We may update these terms. We’ll post the new version here and, for material changes, tell you in the app or by email before they take effect. Continuing to use the Service after that means you accept the changes.
